Every member, regardless of tier or seniority, is bound by the Foundation’s core tripartite motto: JUSTICE • EQUALITY • DIGNITY.
Members shall treat every citizen, applicant, colleague, and community member with uncompromised courtesy and respect. The Foundation strictly prohibits discrimination, bias, or preferential treatment based on religion, caste, sub-caste, gender, marital status, sexual orientation, language, age, disability, geographic origin, or socio-economic standing.

3. Strict Prohibition of Fee Charging (100% Free Public Legal Aid)

All legal literacy, grievance intake, rights counseling, administrative mediation, and procedural guidance rendered by or through the Eternal Social Restoration Foundation are 100% free of charge to the public.
Members and empanelled professionals are strictly barred from: (a) Demanding, soliciting, or receiving any professional fee, consultation fee, filing expense, tip, commission, gift, or commercial reward from any applicant or beneficiary, and (b) Conditioning guidance upon commercial favors or personal reciprocity. Any violation of this rule will result in immediate expulsion and potential reporting to statutory bodies.

4. Panel Advocate Code of Ethics & Bar Council of India Standards

Advocates empanelled on the ESRF Legal Aid Panel remain bound by the Advocates Act, 1961, Bar Council of India Rules, and the statutory charter of the Foundation:
• Pro Bono Commitment: Empanelled advocates serve purely in an advisory, pro bono capacity to evaluate legal merits and guide vulnerable citizens.

• No Unilateral Representation: Panel advocates shall not file Vakalatnamas claiming institutional sponsorship or financial underwriting by ESRF without prior written approval from the Governing Body.

5. Prevention of Sexual Harassment (POSH Act 2013) Zero-Tolerance Mandate

Strict Prohibition of Unauthorized Monetary Transactions: The Foundation does not authorize, encourage, or recognize any personal financial transaction, loan, borrowing, lending, private investment, monetary guarantee, or cash collection between its members, volunteers, office bearers, or beneficiaries. Any monetary transaction entered into by a member shall be deemed strictly a private personal matter undertaken entirely at their personal risk.
2. Absolute Institutional Non-Liability: The Foundation, its Directors, Governing Body, and executive officers bear zero liability for any financial default, recovery dispute, fraud, civil litigation, or criminal consequences arising from private member dealings.
3. Strict Trademark & Reputation Protection: No member is permitted to use the Foundation’s corporate name, CIN, logo, seal, digital ID, letterhead, or goodwill to solicit loans, collect private donations, or execute financial agreements without express written authorization signed by the Board of Directors. Misuse of the Foundation’s name for financial gain will attract immediate summary expulsion and criminal prosecution under Sections 447 and 448 of the Companies Act, 2013.

8. Absolute Judicial Non-Interference in Sub-Judice Litigation

Members must strictly recognize and enforce the Foundation’s institutional boundary: ESRF does NOT intervene, mediate, or provide parallel assistance in active court cases.
No member is authorized to advise applicants to bypass judicial orders, interfere in ongoing court hearings, or represent the Foundation in sub-judice disputes before any judicial tribunal. Members must advise citizens with active court cases to seek relief exclusively through their retained private counsel or official District Legal Services Authorities (DLSA).

• Members are strictly prohibited from copying, retaining, photographing, forwarding, or sharing case files, evidence screenshots, or beneficiary personal information to third parties, private cloud storage, or social media networks.
• Breaches of applicant privacy will result in immediate debarment and statutory reporting to data protection authorities.

11. Disciplinary Proceedings, Suspension & Expulsion Procedure

The Foundation’s Governing Body enforces strict disciplinary mechanisms to protect institutional integrity:
• Inquiry Procedure: Any substantiated complaint regarding moral turpitude, financial solicitation, POSH/POCSO breach, or political misuse will result in immediate interim suspension of membership credentials.
• Right to Heard: The member will be served a formal Show-Cause Notice via registered email and given seven (7) business days to submit a written explanation.
• Summary Expulsion: If the explanation is rejected by the Disciplinary Committee, membership will be terminated permanently. The individual must immediately surrender all physical ID cards, official badges, and pending intake documentation to the Secretariat.

12. Governing Body Discretion & Exclusive Surat Jurisdiction

The Governing Body reserves the sole and final authority to accept, reject, assign chapters, or discontinue any membership without being obligated to assign detailed reasons.
