1. Statutory Vigilance Mandate & Institutional Purpose

In accordance with Section 177 of the Companies Act, 2013 and the Digital Personal Data Protection Act, 2023, the Eternal Social Restoration Foundation has established an institutional Vigilance & Grievance Redressal Mechanism. This policy provides a transparent, secure, and retaliation-free framework for beneficiaries, applicants, volunteers, employees, donors, and citizens to voice genuine grievances, report ethical breaches, and blow the whistle on illicit conduct affecting the Foundation.

2. Scope of Protected Whistleblower Disclosures

A \”Protected Disclosure\” refers to any verified written communication submitted in good faith that reveals or demonstrates information concerning:
• Any financial impropriety, unauthorized solicitation, bribery, or private fee charging from pro bono applicants.
• Gross violations of the Foundation’s Code of Conduct, POSH Act 2013, or POCSO Child Safeguarding protocols.
• Forgery, fabrication, or deliberate tampering with official intake evidence or case records.
• Misuse of the Foundation’s corporate name, emblem seal, CIN, or goodwill for personal aggrandizement.
• Negligence causing substantial danger to public health, child safety, or vulnerable senior citizens.

3. Who Can Submit a Grievance or Protected Disclosure

The grievance and whistleblower portal is universally open to:
• Citizens & Beneficiaries seeking legal aid or counseling who face improper treatment, delays, or fee demands from any volunteer or representative.
• Volunteers, Field Associates, and Empanelled Advocates observing internal irregularities or ethical violations.
• Donors experiencing transaction discrepancies, receipt delays, or miscommunication.
• Members of the public with verified evidence of corporate or statutory non-compliance.

4. Designated Grievance Redressal Officer & Vigilance Committee

To guarantee impartial evaluation, the Governing Body has constituted an independent Vigilance & Grievance Scrutiny Committee headed by a designated Senior Grievance Officer.
The Committee operates independently of day-to-day field operations, maintains direct reporting lines to the Board of Directors, and is empowered to summon case records, conduct neutral factual hearings, and recommend corrective or disciplinary sanctions.

5. Official Channels for Submitting Grievances

Disclosures and grievances may be submitted through any of the following verified channels:
• Electronic Reporting: Direct email to contact@esrfhelp.org with the subject line “Statutory Grievance / Confidential Whistleblower Report”.
• Physical Registered Submission: Addressed in a sealed envelope marked “Confidential — For the Personal Attention of the Grievance Redressal Officer” sent via Registered AD / Speed Post to: 333, 3rd Floor, Rajhans Ornate, Parle Point, Surat, Gujarat, India – 395007.
• Helpline Assistance: Initial guidance via official helpline (+91 91061 03153).

6. 100% Whistleblower Retaliation Shield & Identity Protection

The Foundation guarantees absolute, uncompromised protection to whistleblowers acting in good faith:
• Identity Secrecy: The identity of the complainant shall remain strictly confidential and will not be disclosed to the accused party or unauthorized team members unless required by a court order.
• Zero Retaliation Guarantee: The Foundation prohibits any retaliatory action, harassment, discrimination, suspension, or termination against any volunteer, employee, or applicant who reports a legitimate grievance.
• Any individual who attempts to harass or retaliate against a whistleblower will face immediate summary expulsion and legal action.

7. Mandatory 48-Hour Acknowledgement Protocol

Every formal grievance or whistleblower notice received through official channels will be logged in the Foundation’s Central Vigilance Register.
The Secretariat will issue an official written Acknowledgement of Receipt within forty-eight (48) hours providing a unique Grievance Tracking Reference Number. A preliminary eligibility scrutiny will be conducted within seven (7) business days to determine whether the matter warrants a full factual inquiry.

8. Investigation Procedure & 30-Day Resolution SLA

Validated grievances are investigated following natural justice principles:
• Objective Fact-Finding: The Vigilance Committee examines evidence, inspects records, and hears both the complainant and respondent fairly.
• Time-Bound Resolution: Investigations and final resolution reports must be completed within thirty (30) business days from preliminary admission.
• Written Outcome Notice: The final decision and any disciplinary actions taken will be communicated in writing to the complainant.

9. Prohibition of Frivolous, Malicious, or False Filings

While genuine whistleblowers enjoy an absolute protection shield, the mechanism must not be weaponized for personal vendettas, commercial extortion, or spreading fabricated defamatory claims.
If an inquiry establishes that a complaint was filed deliberately with malicious intent, fabricated documents, or known falsehoods, the individual will be permanently debarred and may be reported to law enforcement authorities under the Bharatiya Nyaya Sanhita (BNS) for criminal defamation and perjury.

10. Board Oversight, MCA Compliance & Surat Jurisdiction

The Vigilance Committee submits a quarterly summary of all grievances received, investigated, and resolved to the Board of Directors for governance oversight. Statistical summaries are maintained for annual statutory filings with the Ministry of Corporate Affairs (MCA).

All matters arising out of this policy shall be governed by the laws of India and subject to the exclusive jurisdiction of the competent courts in Surat, Gujarat, India.
